Genetic Prophecies: The Future of the Canadian Workplace

Abstract: This paper examines how genetic testing affects the Canadian workplace. When genetic testing occurs, or if results are released, the information must not be misused. Access to genetic testing and test results must be regulated through privacy legislation; yet an exclusive focus on privacy is misguided. Consideration should be given to whether the anti-discrimination provisions in existing human rights legislation can protect against genetic discrimination once information is accessed. This article argues that the existing prohibitions against disability discrimination within human rights codes can and should be interpreted and applied to encompass genetic discrimination and that this route is preferable to creating gene-specific legislation.
